Home Watch Service Agreement

This agreement governs all Home Watch subscription services provided by Siesta Stays, LLC.

1. Parties and Purpose

This Home Watch Service Agreement (“Agreement”) is entered into between Siesta Stays, LLC (“Company,” “we,” “our”), a Florida limited liability company, and the individual or entity subscribing to our Home Watch services (“Client,” “you,” “your”).

The purpose of this Agreement is to establish the terms and conditions under which we will provide regular inspection and monitoring services for your property while you are away.

2. Service Plans

We offer three Home Watch subscription plans. Pricing is based on your selected plan and property square footage:

Essential Plan (2 visits/month):

  • Up to 1,500 sq ft: $95/month
  • 1,501–3,000 sq ft: $120/month
  • 3,001–5,000 sq ft: $150/month

Standard Plan (4 visits/month):

  • Up to 1,500 sq ft: $150/month
  • 1,501–3,000 sq ft: $185/month
  • 3,001–5,000 sq ft: $225/month

Premium Plan (4 visits/month):

  • Up to 1,500 sq ft: $225/month
  • 1,501–3,000 sq ft: $275/month
  • 3,001–5,000 sq ft: $325/month

Properties over 5,000 square feet require a custom quote.

2.1 Services Included in All Plans

  • Full interior and exterior inspection
  • GPS-verified photo report after every visit
  • AC and humidity monitoring
  • Mail and package collection

2.2 Additional Services by Plan

Standard Plan adds:

  • Plant watering
  • AC filter check and replacement (owner-supplied filters)
  • Post-storm condition check
  • 1 keyholder/vendor/cleaner access visit per month (up to 30 minutes)
  • Priority scheduling for add-on services

Premium Plan adds all Standard features plus:

  • Priority storm response
  • Owner arrival/departure coordination
  • Pre-arrival ready check before owner return
  • Preventive AC condensate line treatment/check
  • Unlimited keyholder/vendor/cleaner access visits (up to 30 minutes each)

3. Additional Services and Fees

The following services may be requested at additional cost:

  • Additional Visit (beyond plan allocation): $65 per visit
  • Vehicle Check: $15 per vehicle checked once per month
  • Key Delivery: $25
  • Maintenance Services: $50/hour (regular), $75/hour (after hours/weekends)
  • Maintenance Trip Charge: $75 (waived if already on-site for scheduled visit)
  • Pre-Storm Preparation: $75/hour
  • Post-Storm Labor: $50/hour
  • Sandbags: $12 each (placement labor billed separately)

4. Client Responsibilities

To enable us to perform our services effectively, you agree to:

  • Provide accurate property access information including keys, codes, and instructions
  • Notify us of any changes to access information, alarm codes, or emergency contacts
  • Maintain current and valid payment information on file
  • Ensure the property is in a safe and accessible condition
  • Inform us of any known hazards, issues, or special circumstances
  • Provide contact information for at least one emergency contact
  • Notify us of your expected return dates when known

5. Property Access and Entry

You authorize Siesta Stays and its designated representatives to enter your property for the purpose of performing Home Watch services. We will:

  • Use access methods only as instructed by you
  • Secure the property upon departure
  • Never provide access to unauthorized individuals
  • Coordinate vendor or service provider access only with your prior approval

5.1 Lockbox Installation Authorization

If you provide a physical key rather than an existing lockbox or electronic access method, you authorize Siesta Stays to install a secure lockbox at your property for use during Home Watch visits. The lockbox will be:

  • Installed in a discreet location agreed upon with you
  • Secured with a combination code known only to Siesta Stays personnel
  • Never labeled with your property address or other identifying information
  • Removed upon termination of services if requested

You may opt out of lockbox installation by providing an alternative access method such as an electronic lock code or garage keypad entry.

Key/Access Security: Keys and access codes entrusted to Siesta Stays will be stored securely and will never be labeled with your property address. We maintain strict protocols to protect your property access information.

6. Reporting and Communication

After each scheduled visit, you will receive a GPS-verified photo report documenting the condition of your property. Reports are typically delivered within 24 hours of the visit.

If we discover any issues requiring immediate attention (water intrusion, pest activity, security concerns, HVAC failure, etc.), we will:

  1. Attempt to contact you immediately by phone
  2. Follow up with email and/or text message
  3. Contact your designated emergency contact if we cannot reach you
  4. Take reasonable protective measures if the situation is urgent and we cannot reach anyone

7. Billing and Payment

Home Watch subscriptions are billed monthly. By subscribing, you authorize us to charge your designated payment method on a recurring basis.

  • Subscription fees are charged on your billing date each month
  • Additional services are added to your next billing cycle
  • All fees are non-refundable once services have been rendered
  • You may update your payment method at any time through our customer portal

8. Term and Cancellation

Your subscription continues on a month-to-month basis until cancelled.

  • You may cancel at any time by providing written notice (email is acceptable)
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial months
  • We may suspend or terminate services for non-payment or violation of this Agreement
  • Upon cancellation, you agree to retrieve any keys or access devices within 14 days

8.1 Seasonal Pause

If you return to your property seasonally, you may request to pause your subscription. Please contact us at least 7 days before your return to arrange a pause. Pauses must be for a minimum of one full billing cycle.

9. Limitations of Liability

Siesta Stays provides inspection and monitoring services only. We are not a security company, insurance provider, property manager, or contractor.

Important: Our services do not replace homeowner’s insurance, security monitoring, or property management. We strongly recommend maintaining appropriate insurance coverage for your property.

You acknowledge and agree that:

  • We inspect properties at scheduled intervals and cannot monitor continuously
  • We are not responsible for events occurring between scheduled visits
  • We will report issues discovered but are not responsible for pre-existing conditions
  • Our liability is limited to the amount of fees paid in the 12 months preceding any claim
  • We are not liable for acts of nature, third-party actions, or circumstances beyond our control
  • We are not responsible for loss, theft, or damage unless caused by our gross negligence

10. Insurance

Siesta Stays, LLC maintains general liability insurance coverage. However, this coverage does not extend to your property or personal belongings. You are responsible for maintaining your own homeowner’s insurance and any other coverage appropriate for your property.

11. Indemnification

You agree to indemnify and hold harmless Siesta Stays, LLC, its owners, employees, and agents from any claims, damages, or expenses arising from:

  • Conditions existing at your property
  • Inaccurate information provided by you
  • Actions of third parties at your property
  • Your failure to maintain appropriate insurance coverage

12. Emergency Authorization

In the event of an emergency threatening immediate damage to your property (active water leak, fire, break-in, etc.) where we cannot reach you or your emergency contacts, you authorize us to:

  • Take reasonable protective measures (such as shutting off water)
  • Contact emergency services (fire, police) if appropriate
  • Engage emergency repair services up to a maximum of $500 without prior approval

Any emergency expenditures will be documented and billed to you with receipts.

13. Confidentiality

We will maintain the confidentiality of your personal information, access codes, and property details. We will not share this information except as necessary to perform our services or as required by law.

14. Service Area

Our Home Watch services are currently available in the following ZIP codes:

  • 34242 (Siesta Key)
  • 34231 (Sarasota)
  • 34239 (Sarasota)

Service availability in other areas may be considered on a case-by-case basis.

15. Modifications to Agreement

We reserve the right to modify this Agreement or our pricing with 30 days written notice. Continued use of our services after such notice constitutes acceptance of the modified terms. Material changes to pricing will take effect at your next billing cycle following the notice period.

16. Governing Law and Disputes

This Agreement is governed by the laws of the State of Florida. Any disputes arising from this Agreement shall be resolved in the courts of Sarasota County, Florida.

17. Entire Agreement

This Agreement constitutes the entire understanding between you and Siesta Stays, LLC regarding Home Watch services and supersedes any prior agreements or understandings.

18. Acceptance

By subscribing to Siesta Stays Home Watch services and completing payment, you acknowledge that you have read, understand, and agree to be bound by the terms of this Agreement.
